TFP Raipur; August 5, 2024: In a landmark move to protect consumer interests and ensure transparency, the Supreme Court has issued strict directives to AYUSH drug manufacturers, advertisers, and advertising agencies to prevent misleading advertisements.
As per the directives, stemming from the case of Indian Medical Association (IMA) & Others vs. Union of India & Others, advertisers and advertising agencies are now required to submit a self-declaration certifying compliance with the advertisement code under the Cable Television Network Rules, 1994, before broadcasting or publishing any advertisements. This order, issued on May 7, 2024, mandates that these self-certifications must be uploaded to designated portals prior to the airing or publication of any ads.
The Ministry of Information and Broadcasting has facilitated this process by launching new features on its Broadcasting Services Portal and the Press Council of India’s portal. These portals, operational since June 4, 2024, allow advertisers to upload their self-declarations, ensuring that their advertisements meet regulatory standards before they are broadcasted or published.
The Supreme Court’s order emphasizes the maintenance of records by broadcasters, printers, publishers, TV channels, and electronic media to verify the compliance of advertisements with the prescribed codes. This move is part of a broader effort to curb misleading advertisements and safeguard the public from false claims.

These platforms provide an efficient way for advertisers to ensure their content adheres to legal standards, promoting a more transparent and accountable advertising environment.
