Lok Sabha membership annulled for Congress leader Rahul Gandhi
24/03/2023; Bureau Report: Congress leader Rahul Gandhi’s membership of the Lok Sabha has been void by the speaker Shri Om Birla today. In a notification issued by the Lok Sabha Secretariat, states that Mr. Rahul Gandhi has been disqualified under Article 102(1) of the Constitution and Section 8 of the Representation of the People Act 1951. It has also been said that his disqualification order will be effective from March 23, 2023. Birla took decision against the Rahul Gandhi’s punishment order issued by the dist. session court of Surat in Gujrat state yesterday. A difamation case was filed on Rahul Gandhi’s statements against the surname of “Modi” in the year of 2019.
The Congress leader Rahul Gandhi was a Member of Parliament (MP) from Wayanad in Kerala. According to the Representation of the People Act, if MPs and MLAs have been punished for more than 2 years in any case, then their membership (Parliament and Legislative Assembly) will be cancelled. Apart from this, after completing the sentence period, they are also disqualified to contest elections for six years.
How can it be saved?
Though Rahul Gandhi’s Lok Sabha membership has been cancelled, but his way do not close to save his affiliation. Rahul Gandhi can challenge this decision in the High Court to save his association and accordingly the decision of the Surat court is stayed. If the High Court does not give stay then may be approached to the Supreme Court to get the sojourn. But if there is no relief from the upper court, then Rahul Gandhi will not be able to contest elections for about eight years.
