TFP Bureau, Raigarh, April 3, 2025: The Maharashtra State Electricity Generation Company (Mahagenco) is taking significant strides towards sustainable development and energy conservation with its Gare Palma 2 (GP 2) coal mine project. In addition to promoting environmental balance, the project is expected to generate employment and improve public welfare in the region, particularly in villages such as Saraitola in Raigarh. While delays have hindered the timely delivery of benefits to some villages, the project is poised to make a positive impact on local communities once fully operational.
The GP 2 project has adhered to all necessary legal and administrative procedures to ensure a balance between industrial progress, environmental conservation, and the welfare of local communities. The project’s approval processes reflect transparency and respect for both environmental and community interests.
Gram Sabha Consent and Legal Procedures
The project has successfully followed legal protocols, including obtaining mandatory consent from the Gram Sabha for forest clearance. The GP 2 project received approvals from the Gram Sabha and Gram Panchayat in 2018 and 2019, with meetings conducted under the supervision of local authorities. In November 2019, the Raigarh Collector submitted all required documentation to the government, and by April 2022, the proposal was forwarded to the Ministry of Environment, Forest and Climate Change (MoEF&CC).
Following a comprehensive review, the Forest Advisory Committee (FAC) granted Phase-I forest clearance in May 2022. In January 2023, the project received Stage-II forest clearance, and in July 2024, the final clearance was issued by the state government.
Judicial Validation and Project Legality
The GP 2 project has been validated by the National Green Tribunal (NGT), which, in its January 15, 2024 order, upheld the validity of both the forest clearance and water extraction permissions. The NGT found no objections or challenges to the forest clearance throughout the review process, confirming the project’s adherence to legal and environmental requirements.
PESA Act and Mining Permissions
Under the Panchayats (Extension to Scheduled Areas) Act (PESA), Gram Sabhas have the right to recommend the management of community resources. However, the final decision on major mineral mining leases, including the GP 2 project, falls under the jurisdiction of state and central governments. The project complied with all legal requirements, ensuring no violation of the PESA Act.
